CactusGrow (“we,” “our,” or “us”) is a web-based software-as-a-service platform operated by Jinolo Pty Ltd (ABN 15 651 888 756). By accessing or using CactusGrow (“the Service”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

CactusGrow is an AI-powered video generation platform that creates multiple short-form video variations from a single text prompt. The Service is designed for content creators, social media managers, and businesses looking to scale their video content production.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must be at least 13 years of age to create an account.

4. Cactus Seeds & Payments

  • Cactus seeds are digital credits used to generate videos on the platform.
  • One cactus seed typically generates one video. Premium AI models and higher quality settings may require more seeds per video.
  • The number of seeds required will always be displayed before you confirm generation.
  • Cactus seeds are non-refundable once purchased, except where required by applicable law.
  • Purchased cactus seeds do not expire and remain in your account until used.
  • All payments are processed securely through Stripe. Prices are listed in USD.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Create content that infringes on intellectual property rights of others
  • Generate deepfakes or misleading content intended to deceive
  • Produce content depicting minors in inappropriate situations
  • Attempt to reverse engineer, decompile, or extract the AI models or algorithms
  • Use automated systems or bots to access the Service without authorization
  • Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. Intellectual Property

Your Content: You retain ownership of the prompts you submit. Subject to these Terms, you are granted a license to use the videos generated by the Service for personal and commercial purposes.

Our Service: The CactusGrow platform, brand, logo, and underlying technology are owned by CactusGrow. Nothing in these Terms grants you rights to our trademarks, service marks, or other brand features.

7. Generated Content

  • AI-generated videos are created using machine learning models and may not always produce perfect results.
  • Generated videos are stored temporarily and may be automatically deleted after a retention period.
  • You are responsible for reviewing generated content before publishing to ensure it meets your standards and complies with applicable laws.
  • CactusGrow is not liable for how you use the generated content.

8. Limitation of Liability

To the fullest extent permitted by law, CactusGrow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated content will meet your specific requirements.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time. Upon termination, your right to use the Service ceases, and any unused cactus seeds may be forfeited.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
